What is the Homebuyers Privacy Protection Act (H.R. 2808)

Upcoming changes related to mortgage triggers and mortgage inquiry attributes due to the Homebuyers Privacy Protection Act (H.R. 2808), effective March 4, 2026.

Under this Act, credit bureaus may only provide mortgage inquiry data if the end user is making a firm offer of credit or insurance and meets at least one of the following conditions:

  • Has originated a mortgage for the consumer
  • Is the consumer’s current mortgage servicer
  • Has a defined banking relationship with the consumer
  • Has the consumer’s explicit consent
